Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the BldrOS platform and all associated services provided by Valoria Ventures, LLC d/b/a BldrOS. This AUP is incorporated by reference into our Terms of Use. Capitalized terms not defined herein have the meanings set forth in the Terms of Use.
BldrOS is designed to support legitimate construction business operations. This AUP exists to protect the Platform, its users, and the broader ecosystem of customers, subcontractors, and vendors who interact with the Platform. Violations of this AUP may result in immediate suspension or termination of your account.
1. Prohibited Activities
You may not use the Platform to engage in, facilitate, or promote any of the following:
1.1 Illegal Activity
- Any activity that violates applicable federal, state, local, or international law or regulation.
- Money laundering, terrorist financing, or sanctions evasion.
- Tax fraud, including the submission of fraudulent invoices or the creation of fictitious transactions.
- Operating without required business licenses, permits, or insurance in your jurisdiction.
- Employment law violations, including worker misclassification or wage theft.
1.2 Fraud and Misrepresentation
- Submitting false, misleading, or fraudulent information during account registration or at any time during your use of the Platform.
- Creating estimates, invoices, or financial records that misrepresent the nature, scope, or cost of work performed or materials used.
- Impersonating another person, business, or entity, or falsely claiming an affiliation with any person or entity.
- Creating multiple accounts to circumvent trial limitations, enforcement actions, usage limits, or billing obligations.
- Manipulating reviews, ratings, or performance scores.
1.3 Abuse of Communications Features
- Sending unsolicited commercial messages (spam) via SMS or any other communication channel provided by the Platform.
- Sending messages to individuals who have opted out of receiving communications from you.
- Using the Platform’s telephony features for robocalling, auto-dialing, or any form of automated calling that violates the Telephone Consumer Protection Act (TCPA) or equivalent regulations.
- Recording calls without obtaining all consents required by applicable law.
- Using communication features to harass, threaten, intimidate, or abuse any person.
- Sending messages containing malicious links, phishing attempts, or malware.
- Using the Platform’s phone numbers or messaging capabilities for any purpose unrelated to legitimate construction business operations.
1.4 Abuse of Payment Features
- Processing payments for goods or services not actually provided.
- Using the payment system to transfer funds between related entities for non-business purposes.
- Deliberately initiating chargebacks or disputes in bad faith.
- Using the Platform to process payments for businesses or activities not related to construction services.
- Circumventing or attempting to circumvent platform transaction fees.
1.5 Platform Integrity
- Attempting to gain unauthorized access to the Platform, other user accounts, or the underlying systems and infrastructure.
- Probing, scanning, or testing the vulnerability of the Platform or any associated system or network, except as part of an authorized security assessment with prior written approval from BldrOS.
- Interfering with or disrupting the integrity, performance, or availability of the Platform or its underlying infrastructure.
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Platform.
- Scraping, crawling, or using any automated means to extract data from the Platform without prior written authorization.
- Circumventing or attempting to circumvent any access controls, rate limits, usage limits, or security measures.
1.6 Harmful Content
- Uploading, transmitting, or storing content that contains viruses, malware, ransomware, or any other harmful code.
- Uploading content that is defamatory, obscene, threatening, or that promotes violence or discrimination.
- Uploading content that infringes on the intellectual property rights of any third party.
- Uploading content that violates the privacy rights of any individual.
1.7 Abuse of AI Features
- Submitting content to AI-assisted features for purposes unrelated to construction business operations.
- Attempting to extract, reverse engineer, or probe the underlying AI models or their training data.
- Using AI-generated outputs to deliberately deceive End Customers or third parties about the nature or cost of proposed work.
- Submitting content designed to manipulate, exploit, or produce harmful outputs from AI features.
2. Usage Limits
The Platform imposes usage limits appropriate to each subscription tier, including limits on the number of users, projects, communications, API calls, and storage. These limits are described on our Pricing page and in your account dashboard. Consistently exceeding your plan’s limits may result in a request to upgrade your subscription or a temporary restriction on certain features.
3. Monitoring and Enforcement
3.1 Monitoring
BldrOS reserves the right, but is not obligated, to monitor use of the Platform for compliance with this AUP. Monitoring may include automated systems designed to detect abuse patterns such as high-volume messaging, unusual transaction patterns, or unauthorized access attempts. We do not routinely review the content of user communications or project data except as necessary to respond to support requests, enforce this AUP, or comply with legal obligations.
3.2 Enforcement Actions
If BldrOS determines, in its reasonable discretion, that you have violated this AUP, we may take one or more of the following actions, depending on the nature and severity of the violation:
- Issue a formal warning identifying the specific violation and requiring corrective action.
- Temporarily restrict or suspend specific features or capabilities.
- Temporarily suspend your account pending investigation.
- Permanently terminate your account and all associated data, subject to our data retention obligations.
- Report the violation to applicable law enforcement authorities.
- Pursue legal remedies, including injunctive relief and recovery of damages.
3.3 Investigation
BldrOS may investigate suspected violations of this AUP. During an investigation, we may temporarily suspend access to the affected account or features. We will make reasonable efforts to notify the account holder of the investigation and provide an opportunity to respond, except where doing so would compromise the investigation or pose a risk to the Platform, its users, or third parties.
3.4 Appeals
If you believe an enforcement action was taken in error, you may appeal by contacting appeals@bldros.com within fourteen (14) days of the action. Appeals will be reviewed by a member of the BldrOS team who was not involved in the original enforcement decision. We will respond to appeals within ten (10) business days.
4. Reporting Violations
If you become aware of a violation of this AUP, please report it to abuse@bldros.com. Include as much detail as possible, including the nature of the violation, the account or user involved (if known), and any supporting evidence. All reports will be reviewed and investigated as appropriate.
5. Changes to This Policy
BldrOS reserves the right to modify this AUP at any time. Changes will be communicated through the Platform or via email at least fifteen (15) days before they take effect, except where changes are required to address an imminent security threat or comply with legal requirements, in which case changes may take effect immediately. Your continued use of the Platform after any changes constitutes acceptance of the updated AUP.
